Are you making these common SC hands-free mistakes? How it affects your car insurance in South Carolina.
March 24, 2026

Hey Greenville! Mark Price here from VP Insurance Services. If you’ve spent any time driving down Woodruff Road or navigating the I-85/I-385 interchange lately, you know that our Upstate traffic requires 100% of your attention. But there is a silent budget-killer lurking in your cup holder or passenger seat: your smartphone.

As of February 28, 2026, the "grace period" for South Carolina’s updated hands-free laws has officially ended. Local law enforcement in Greenville and across the state is no longer handing out polite warnings. They are writing citations. And while a fine is annoying, the real pain comes when that ticket hits your driving record and your insurance carrier gets wind of it.

In this post, we’re going to dive into the common mistakes local drivers are making, the reality of the "Hands-Free Act" and most importantly, how these slip-ups can send your premiums for car insurance Greenville SC skyrocketing.

The 2026 Reality: Why "Just Checking a Text" is Costlier Than Ever

South Carolina’s roads are busier than ever. With more people moving to the Upstate every day, the Department of Public Safety has tightened the reins on distracted driving. The law is clear: you cannot hold a wireless communication device while operating a motor vehicle.

4 Common Mistakes Greenville Drivers Make (That Are Now Illegal)

  1. The "Red Light Scroll": You must be "lawfully parked" to use your device. Being stopped at a red light does not count.
  2. The "Shoulder Wedge": The law prohibits supporting a device with any part of your body (shoulder, lap, etc.).
  3. The "Quick App Tap": Even a brief interaction with Spotify or notifications while in motion is a violation.
  4. The "Video Call Commute": Watching videos or participating in video calls (even in a mount) is prohibited.

The Financial Fallout: Fines, Points, and Your Wallet

  • First Offense: $100 fine.
  • Subsequent Offenses: $200 fine and 2 points on your driving record.

How Distracted Driving Impacts Your Car Insurance

Insurance companies see a hands-free violation as a major risk. This can lead to:

  • Risk Surcharges: Higher premiums that stay for years.
  • Loss of Discounts: Goodbye to "Safe Driver" or &"Claims-Free" savings.
  • Tier Reclassification: You might be moved to a "Non-Standard" (more expensive) tier.

How to Stay Legal and Keep Your Rates Low

  • Invest in a Mount: A $15 vent mount is your best friend.
  • Use "Do Not Disturb": Set your phone to silence notifications while driving.
  • Set Tech Before You Shift: Get your GPS and music ready before pulling out.

If you’ve already received a citation, don't panic. At VP Insurance Services, we work with multiple carriers to find the most "forgiving" rates.

South Carolina is famous for its "free windshield" law, but things are about to change. Here’s the breakdown of House Bill 4817 (The Insurance Rate Reduction and Policyholder Protection Act): The "Good News" First: The automatic zero-deductible (free) windshield replacement is staying exactly as it is through December 31, 2026. The 2027 Shift: Starting January 1, 2027, this benefit won’t be automatic. You’ll need to "opt-in" to it, likely for a small extra premium. The Safety Net: A Senate amendment caps windshield deductibles at $100, so even if you don't opt-in, you won't be hit with a massive out-of-pocket bill. The Goal: This shift aims to reduce insurance fraud and help lower overall auto insurance premiums across the state. At VP Insurance Services, we’re already tracking these changes for you. We’ll make sure your coverage stays exactly where it needs to be when the new rules take effect.
